Ex-Bookkeeper Indicted for Embezzlement in Colo. Fed. Ct.

On May 17, in the U.S. Dist. Ct. for the Dist. of Colo., Barbara Ann Hayes, frmr. bookkeeper and ofc. secy. for United Food & Commercial Wrkrs. Local 990, was indicted on 35 counts of embezzling $27,248.82 in union funds.  The charges follow an investigation by the Denver Dist. Ofc. of the U.S. Ofc. of Labor Mgmt. Standards. Ex-Secy.-Treasurer Pleads Guilty to Embezzlement in Ohio Fed. Ct.

On May 18, in the U.S. Dist. Ct. for the North. Dist. of Ohio, Darryl Maynard, frmr. secy.-treasurer of Local 816 of the Paper, Allied-Industrial, Chem. & Energy union, pled guilty to one count of embezzling $7,309 in union funds.  The guilty plea follows an investigation by the Cleveland Dist. Ofc. of the U.S. Ofc. of Labor Mgmt. Standards. [OLMS, 6/1/04]

 

NYC Member Pleads Guilty to Conspiracy

On May 14, in the U.S. Dist. Ct. for the East. Dist. of N.Y., Edward Lynch, a member of Elevator Constructors Local 1, pled guilty to an information charging him with two counts of conspiracy. Count 1 related to unlawful labor payments and conspiracy to commit mail fraud and Count 2 related to defrauding the government of income taxes.  This investigation was part of an ongoing investigation involving the Elevator Constructors Local One operator no-show job scheme.  Charges were filed following a joint investigation by the N.Y. Dist. Ofc. of the U.S. Ofc. of Labor Mgmt. Standards, the Dept. of Labor’s Employee Benefits Security Admin., the FBI, and the IRS. [OLMS, 6/1/04]

 

DOL Seeks New Teamsters Election in NY

On April 30, in the U.S. Dist. Ct. for the East. Dist. of N.Y., the U.S. Dept. of Labor filed a complaint against Teamsters Local 804 seeking to supervise a new election of officers. The complaint alleges that the local failed to verify the eligibility of the nominees, nominators, and seconders prior to concluding its nominations meeting on October 5, 2003.  As a result, otherwise eligible nominees were prevented from correcting any procedural defects in their nominations.  The complaint further alleges that the local denied an eligible nominee the opportunity to run for president when the local incorrectly found the nominee’s seconder to be out of good standing.  The complaint seeks a new election for president under OLMS supervision.  The complaint follows an investigation by the N.Y.
